Recovering Veterinary Costs After a Fatal Dog Attack

A Routine Walk Ends in Tragedy

Our elderly client was preparing to walk her dog around the neighborhood when, as she passed a neighboring home, another dog ran towards them and began attacking her dog. The attacking dog latched onto our client’s dog’s neck, causing severe injuries. While attempting to separate the two dogs, our client also sustained several lacerations and bruises. Tragically, despite receiving veterinary treatment, our client’s dog ultimately succumbed to its injuries.

Although our client recovered from her physical injuries, she sought compensation for the veterinary expenses incurred as a result of the attack, including the costs of emergency treatment and the eventual cremation of her dog.

Building the Evidence to Support the Claim

To substantiate our client’s claim, we obtained the complete veterinary file from the treating veterinarian. This included the dog’s medical records both before and after the incident, allowing us to confirm that the dog had been in good health prior to the attack and that the injuries sustained were the direct cause of its death.

We also reviewed the veterinary clinic’s accounting records, which detailed the costs of the medications, treatments, and services provided as a result of the incident. These records enabled us to accurately quantify our client’s financial losses.

The Legal Challenge: Proving Causation Without Insurance

The primary issue in this matter was causation. Liability was not disputed, as the Defendant admitted that their dog was involved in the attack. However, the Defendant denied that their dog was responsible for our client’s dog’s death and, as a result, disputed responsibility for the veterinary expenses incurred.

Furthermore, the Defendant did not have a valid homeowner’s insurance policy that would have provided coverage for this type of incident. Without an insurer involved, recovering compensation became significantly more challenging.

A comprehensive package containing a notice letter, demand letter, and the supporting veterinary records was delivered to the Defendant. The demand clearly itemized the expenses being claimed and requested payment within a specified timeframe, failing which we would commence a formal claim in the Small Claims Court.

A Successful Resolution Without Going to Court

On the final day before the claim was to be issued, the Defendant delivered a cheque for the full amount requested in our demand letter, down to the last penny. This resolution spared both parties the additional time, expense, and uncertainty associated with formal litigation.

How Preparation Led to a Full Recovery

Our prompt action and thorough preparation enabled our client to recover the full amount of the expenses incurred as a result of the dog attack. The detailed demand letter clearly outlined the damages being claimed, making the basis of the claim easy to understand and difficult to dispute.

By resolving the matter before litigation became necessary, we avoided the additional costs and delays associated with a Small Claims Court proceeding. This was particularly meaningful, as we handled the matter on a pro bono basis.

This case serves as a reminder that even smaller claims deserve careful attention. Our preparation, attention to detail, and strategic approach helped secure a positive outcome for our client without the need for court proceedings.
