Grocery Store Slip and Fall Leads to Traumatic Brain Injury Claim in Ontario

Incident Overview: Grocery Store Slip and Fall Claim

Our client reached out to us following a grocery store slip and fall. She was visiting a grocery store to buy a flower arrangement for her friend. While at the grocery store, our client suffered a serious slip and fall accident. She was browsing the floral displays, she slipped on a puddle of water and struck her head on the floor, resulting in a traumatic brain injury (TBI).

We investigated the grocery store slip and fall incident by gathering all the evidence we needed.  In order to put together the grocery store slip and fall claim, we:

  • Sought out the grocery store surveillance footage
  • Got witness statements regarding the slip and fall.

It was crucial that we got these items as quickly as possible following the grocery store slip and fall because memories fade quickly sometimes.

Injuries and Medical Care Following the Grocery Store Slip and Fall Claim

Initially, our client felt embarrassed and believed she was unharmed following her grocery store slip and fall claim. She opted to not seek immediate medical attention. However, when her symptoms worsened from her grocery store slip and fall accident the following morning, she consulted her physician. After this, she was diagnosed with a concussion – a form of mild traumatic brain injury. She followed the medical advice that her physician suggested. That being said, she continued to have symptoms that persisted afterwards. These symptoms from her grocery store slip and fall accident have significantly impacted her daily life.

We assisted our client in accessing medical treatment funded by her employment benefits after her grocery store slip and fall accident. Though she was able to return to work after her lengthy recover, her ongoing symptoms from her grocery store slip and fall has prevented her from:

  • Pursuing higher-paying positions
  • Advancing her career
  • Performing well in job interviews
  • Taking on more responsibilities

These long-term side effects were directly linked to her brain injury cause in the grocery store slip and fall accident.

Litigation Process: Building a Strong Grocery Store Slip and Fall Claim

We initiated a slip and fall personal injury claim against the grocery store. We provided comprehensive support throughout the discovery phase and prepared thoroughly by obtaining:

  • expert medical reports
  • liability evidence
  • vocational assessments

The case proceeded to mediation, where we successfully resolved her grocery store slip and fall claim for an amount that reflected her losses.

We were also able to recover a substantial general damages award which reflected her inability to complete her farming tasks – something she loved to do with her husband when she wasn’t working and enjoy the horses that she loved to ride.  We were also able to recover a fair amount for her ongoing treatment needs and, although she was close to retirement at the time of the incident, we were able to recover the shortfall in income because of her inability to pursue higher paying jobs

Outcome: Successful Settlement Through Mediation for the Grocery Store Slip and Fall Claim

The grocery store slip and fall claim was resolved at mediation, allowing our client to avoid further litigation. Our meticulous preparation ensured a positive outcome, underscoring the importance of treating every case as though it may proceed to trial.

We were pleased to represent this client and are proud of the result achieved on her behalf in this slip and fall injury case.
