The Ontario Budget and Injury Law

The Ontario Trial Lawyers Association provided this update on the Ford government’s first budget.

The government has announced there will be updates to auto insurance over the next several years with no reduction in benefits to victims. Some positive announcements include $2 million in coverage for medical rehabilitation and attendant care for catastrophically injured victims.

They are also amending the simplified rules to increase limits and reduce the use of juries.

The government has also announced procedural changes to accident benefits – though the details and impact are unclear for now. One issue of concern is that the government intends to prohibit the cashing out of accident benefit claims. There are concerns this could limit access to justice for those who cannot afford legal help.
