Accident Benefits for Catastrophically Injured Drivers/Passengers/Pedestrians

Drivers, passengers and pedestrians who are catastrophically injured in car or truck accidents in Kingston, Ottawa or Whitby may receive statutory accident benefits from their own car insurance companies. Accident benefits are defined by Ontario’s Statutory Accident Benefits Schedule (SABS), and some of the benefits available are the following

• in the event of death, death and funeral benefits.

Amount of Accident Benefits

One of the most important accident benefits for individuals who suffer catastrophic injuries, such as traumatic brain injuries or quadriplegia, is the medical and rehabilitation care benefit. This benefit is crucial because it covers reasonable medical and rehabilitation care not covered by a government health plan or a private health plan.

For catastrophically injured individuals, extensive medical treatment is often required and medical bills can add up quickly. Catastrophically injured individual are eligible to receive up to $1,000,000 of medical and rehabilitation care benefits.

Attendant Care Benefits

One type of accident benefit not available to all injured drivers and passengers is the attendant care benefit. This benefit is only available to individuals with serious or catastrophic injuries.

Many seriously and catastrophically injured drivers/passengers can no longer take care of themselves. They may require assistance performing the following daily activities:

  • bathing,
  • toileting,
  • grooming, and

• feeding.

Attendant care benefits cover reasonable and necessary expenses incurred as a result of catastrophically injured drivers/passengers being unable to care for themselves. Therefore, the injured car accident victims may hire a home aid or may need to stay in a long-term care home facility.

Catastrophically injured car accident victims may receive $6,000 a month for attendant care benefits, up to a total of $1,000,000.

In order to qualify for attendant care benefits, a form (Form 1) must be completed by a registered nurse or occupational therapist to assess how much assistance is needed.
