Kingston, Ottawa & Whitby Intersection Car Accidents & Brain Injuries – What are your Legal Rights? (Part 1)

As a driver in Ontario, you practice safe driving. You make sure you stop completely at stop signs. When you see a yellow light at an intersection, you slow down instead of trying to beat the light. You obey the speed limits. You do all of this because you want to make sure you are not in a car accident.

Unfortunately, despite how careful you are, other drivers on the roads may not practice safe driving. As a result, they cause serious car or truck accidents in Kingston, Ottawa or Whitby, and the injured drivers and passengers may sustain catastrophic injuries.

Imagine the following scenario. Driver A is stopped at a red light at an intersection in downtown Kingston. The light turns green, and Driver A starts to go. As he enters the intersection, Driver A is violently hit by another car. Driver B was not paying attention as he was approaching the intersection and did not stop his car when he had a red light. As a result, he crashes into the driver side of Driver A’s car.

After the impact, Driver A’s airbag deploys, his car spins several times, and Driver A is thrown around in the car even though he is wearing a seat belt. In the process, Driver A’s head hits the side window, steering wheel and head rest several times.

This scenario is a common type of car accident in Kingston, Ottawa and Whitby. Many accidents happen at intersections because negligent drivers do not see traffic signals. In fact, injured individuals often sustain serious and/or catastrophic injuries as a result of intersection car accidents. When a driver’s head is hit several times as in the above scenario, he may sustain a serious head injury or even a traumatic brain injury.

A brain injury can be a life changing event for the injured individual and his family. The injured individual’s life can be literally turned upside down. He may have severe emotional, cognitive, mental and behavioural changes as a result of the brain injury. He may no longer be able to work because his short-term and long-term memory are affected.

Many injured drivers/passengers and their families are at a loss after catastrophic car accidents. However, they do have legal rights and may take legal action in order to obtain compensation for their injuries and the resulting life changes.
