Motorcycle-Car Accidents Near Ottawa & London Kill Both Riders

Accidents happen throughout Ontario, including Ottawa, every day. However, motorcyclists face a greater risk of serious and fatal accidents than automobile drivers or passengers. According to the Ontario Ministry of Transportation, the most recent data shows that in 2011, 1,326 riders were injured in motorcycle accidents, and 36 riders were killed. In addition, 478 motorcycle passengers were injured in 2011, and 2 were killed.

One of the reasons motorcycles put people at a higher risk of serious accidents is due to the size of motorcycles compared to other motor vehicles on the road. Further, if cars are traveling at high speeds, collisions with motorcycles can result in catastrophic injuries to the motorcyclists. Injuries may include:

  • loss of limbs,
  • permanent traumatic brain injuries, or
  • spinal cord injuries.

Many times, serious motorcycle-car accidents end in tragic fatalities. Last week, on September 18, 2014, a man riding his motorcycle just outside of Ottawa died as a result of a motorcycle-car accident. The 38 year old motorcyclist collided with a car driven by a 77 year old woman. The motorcyclist died at the scene. The cause of the accident is under investigation, and no charges have been filed.

However, in another fatal Ontario motorcycle-car accident near London earlier this month, the driver of the car has been charged with dangerous operation of a motor vehicle causing death and causing death by criminal negligence.

The driver was traveling westbound on the road, allegedly crossed the centre lane and struck the motorcycle traveling in the opposite direction. The 55 year old rider was pronounced dead at the scene.

Accident Benefits for Motorcyclists Injured in Motorcycle-Car Accidents

Seriously injured motorcyclists are eligible to receive statutory accident benefits pursuant to Ontario law. However, many injured motorcyclists may not realize that these benefits actually come from their own auto insurance companies. The no-fault principle in Ontario requires an injured motorcyclist's own auto insurance company to pay for accident benefits, including medical and rehabilitation benefits, even though the accident was not caused by the motorcyclist.

Applying for accident benefits from a motorcyclist's own car insurance company may not be easy. In fact, it is often complicated. Many injured motorcyclists may not receive the full amount of benefits they are eligible to receive for their catastrophic injuries. Therefore, it is important to seek help from a motorcycle-car accident lawyer in Kingston and Ottawa who specializes in obtaining statutory accident benefits for catastrophically injured motorcyclists, drivers or passengers. Talk to the car and motorcycle accident lawyers at Bergeron Clifford who have extensive experience in helping car and motorcycle accident victims obtain accident benefits. 1-866-384-5886
