Whiplash and Soft Tissue Injuries

The majority of soft tissue injuries resolve fairly quickly. While we always encourage clients to call us to learn about their rights and discuss their case with us, we often tell them that for soft tissue injuries, they should give physiotherapy and the passage of time a fair try before pursuing a lawsuit.

Bergeron Clifford LLP has a reputation as lawyers who do not take on frivolous cases, and it's important to us. When we do take on a whiplash or soft tissue injury case, it's because physiotherapy and time have not cured the injury. It's because the injury is still there, and still causing pain and disruption in a client's life.

At that point, it's our job to step in.

Whiplash, Sprains, Strains And Tears

Whiplash and other soft tissue injuries can be serious, depending on factors such as:

  • The circumstances of your accident: If you are in a motor vehicle accident, your injuries may depend on whether you are in the front or back of the car, and how close you are to the site of impact. A head-on crash will also move your body differently from a rear-end impact crash, and may cause worse injuries.
  • The stress on your body from the impact: Whiplash involves both a whip forward and a lash back of your head, straining your neck muscles and possibly damaging your brain as well. It may also be accompanied by concussion or shoulder injuries from your seat belt.
  • Damage to muscle, ligaments and tendons: Sprains, stretches, tears and strains can cause severe pain for a long time after the accident. They can sometimes be caused by repetitive stress on one part of the body while you heal, such as by putting too much stress on your right leg while walking with an injured left knee.

Soft tissue injuries are often invisible and may not have as extensive a medical history as other injuries. There may also be no X-ray or CT or MRI evidence for them. You may be told — and believe — that you should be able to recover quickly, and be upset when you can't.

The lack of support and understanding can be difficult to deal with. We can help.
